29 CFR 1926.304(d): All portable, power-driven circular saws were not equipped with guards above and below the base plate or shoe. The lower guard did not cover the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work. When the tool is withdrawn from the work, the lower guard did not automatically and instantly return to the covering position: a) At the new single family residential construction site, where employees were exposed to struck-by hazards while operating a Skillsaw with the lower guard in the opened position.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer did not develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: a). At the single family residential construction site, employees were exposed to fall hazards of approximately 10-feet above the ground level below while performing framing work without the use of a guardrail system or personal fall arrest system.
