Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to flammable dust deflagration hazards while working at or near indoor flammable dust collection systems which were not adequately designed to prevent or minimize employee exposure in the even of a deflagration: (a) An indoor Farr Tenkay Dust Collector located in the Grinding Room was used for collecting black pepper dust and contained deflagration venting that discharged into the work area. In addition, the dust collector lacked means of deflagration protection (isolation) for the upstream process. (b) An indoor Donaldson Dust Collector located in the Utility Room was used for collecting cinnamon and all-spice dusts and contained deflagration venting that discharged into the building. In addition, the dust collector lacked means of deflagration protection (isolation) for the upstream process. (c) An indoor Donaldson Dust Collector located in the Utility Room was used for collecting funnel dust and contained deflagration venting that discharged into the building. In addition, the dust collector lacked means of deflagration protection (isolation) for the upstream process.

29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet: (a) The list of chemicals was incomplete in that it did not include spices, such as Black Pepper, Cassia (AKA: Cinnamon), Fennel Seed, and All Spice. Hazards of these substances include irritation effects and generation of combustible dusts during processing.
