29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    Mulching Yard, The Pond: On, or about, 12/16/2015 the employees performing the wood splitting operation were not protected from injury in the following instances:    (a) Multitek 2040XP2 Fuelwood Processor: The chain guard at the front of the splitting chamber was not installed per the manufacturers specifications whereby the employees were not protected from flying fragments of wood during the cutting process.    (b) Multitek 2040XP2 Fuelwood Processor: The employee manually removing the wood from the splitting chamber was not protected from the rotating saw blade.     (c) Conveyor (Ser #CC981007): Employees working in close proximity to the conveyor were not protected from the in-running nip points of the rotating belt and rollers.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:    Mulching Yard, The Pond: On, or about, 12/16/2015 the affected employees performing tasks near the Multitek 2040XP2 Fuelwood Processor were exposed to flying particles of wood whereby they were not wearing eye or face protection.        The Mulch 'n More, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.133(a)(1), which was contained in OSHA inspection number 924428, citation number 1, item number 3 and was affirmed as a final order on 12/31/2013, with respect to a workplace located at 51 Hammond Street, Newport, Rhode Island.
