29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces and side brackets were used as a means of access:     West side on a commercial building, on or about December 16, 2015, employee(s) were exposed to falls greater than 35 feet in height to the unpaved ground level below while climbing the side brackets of the scaffold to access and egress the 6th tier level of the scaffold.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:   West side on a commercial building, on or about December 16, 2015, employee(s) were exposed to falls greater than 35 feet in height to the unpaved ground level below when working from the 5th tier of a scaffold that did not have guardrails installed on the sides of the extension brackets, while applying weather tape on an exterior wall.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  West side on a commercial building, on or about December 16, 2015, employee(s) were exposed to falls greater than 35 feet in height to the unpaved ground level below while not being trained to recognize the hazards when applying weather tape to an exterior wall from a scaffold that had hazards such as but not limited to: no guardrails installed on sides, no ladder for access, and a plank that was less than 18 inches.
