29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system:    On or about December 17, 2015 at the Tuscany jobsite located in Centerton, Arkansas, employees standing on planks and the top of the form to pour concrete into manhole forms and vibrate concrete in manhole forms were not protected from falling into the trench below in the following instances:    a.     Plank from the east side of the manhole form to the east side of the trench    b.     Plank from the west side of the manhole form to the west side of the trench    c.    Top of the form

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    On or about December 17, 2015 at the Tuscany jobsite located in Centerton, Arkansas, employees standing on walk boards to pour concrete into manhole forms and vibrate concrete in manhole forms were not provided with training on how to recognize fall hazards and procedures to be followed.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) and (c):      Employees working in a vertical walled trench greater than 5 feet in depth  located at the Tuscany jobsite in Centerton, AR were not protected from cave-ins in the following instances:    a.  On or about December 16, 2015 employees were in the trench installing forms and pouring concrete into the forms.    b.  On or about December 17, 2015 employees were in the trench inspecting forms prior to concrete being poured, making a manhole key (keyway) after the forms were removed and concrete flowed out and inspecting the manhole key  (keyway) after it was made.
