29 CFR 1910.178(l)(3)(i)(M): Powered industrial truck operators did not receive initial training in the following topics to include but not limited to operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate: (a) FCA U.S. LLC, on or about December 21, 2015, at the address of 4400 Chrysler Dr. Toledo, OH: The employer failed to ensure operating maintenance employees were trained specifically on the manufactures procedures for towing and mounting a Taylor-Dunn Industrial Tow Tractor (Model E-453). The employer did not instruct operating employees on, and ensure the implementation of, the manufactures instruction relating to vehicle towing as well as ensuring electrical controls are neutralized prior to mounting. Operators and other employees working on or around the aforementioned unit in this condition were exposed to struck-by hazards.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set: (a) FCA U.S. LLC, on or about December 21, 2015, at the address of 4400 Chrysler Dr. Toledo, OH: The employer failed to ensure a Taylor-Dunn Industrial Tow Tractor (Model E-453) operator neutralized controls prior to leaving the vehicle unattended. Power industrial vehicles left unattended with the power switch in the on position and drive switches engaged, exposed other employees working on or around the aforementioned unit to unexpected movement of the vehicle and struck-by hazards.
