29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits as required.        a) Talenti Gelato: The employer failed to ensure that the ammonia detection system maintained sensor equipment that was available and/or in an operable condition. The lower engine did not maintain a ammonia detection sensor and/or an operable sensor exposing employees to an ammonia inhalation hazard.

29 CFR 1910.119(j)(6)(iii): The employer did not assure that maintenance materials, spare parts and equipment are suitable for the process application for which they will be used.     a) The employer failed to ensure that the piping on the intercooler tank was sufficient in size for the ammonia operating system. The employer was utilizing an approximately 3/4 inch diameter; 4 inch threaded schedule 80 pipe nipple that was connected to the intercooler tank in the lower engine room. The attached pipe was not of sufficient size for the production being generated and was not structurally sound for being used in the ammonia operating system.  Employees were exposed to an inhalation hazard from an exposure to ammonia.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:     (a) Talenti Gelato:  Employees required to utilize a tight-fitting full face respirator (3M) 6000 series while performing maintenance and repairs on an enclosed recirculating ammonia refrigeration system did not receive a medical evaluation to determine the employees ability to utilize a respirator.
