29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a)  In the Exteriors area, on or about December 15, 2015, a hearing conservation program was not implemented for the employee who was exposed to noise at 148% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 87.8 dBA during the 399 minute sampling period, resulting in a noise hazard.    (b)  In the Floors area, on or about December 15, 2015, a hearing conservation program was not implemented for the employee who was exposed to noise at 118% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 86.2 dBA during the 374 minute sampling period, resulting in a noise hazard.    (c)  In the Tops area, on or about December 15, 2015, a hearing conservation program was not implemented for the employee who was exposed to noise at 106% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 85.4 dBA during the 195 minute sampling period, resulting in a noise hazard.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (a)  Throughout the facility, on or about December 15, 2015 and at times prior to, the employer did not provide basic advisory information contained in Appendix D to employees who used filtering facepiece respirators on a voluntary basis, resulting in a respiratory and dermal hazard.
