29 CFR 1910.147(d)(3): All energy isolating devices that were needed to control the energy to the machine or equipment were not physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s a) D&W Fine Pack - On or about April 19, 2016, the rotary disconnect used to lockout electrical hazards on foil press number 6 was not turned off and locked out while an employee was sharpening the dies under the ram, exposing the employee to crush/amputation hazards. b) D&W Fine Pack - On or about April 19, 2016, the main airline shut off valve used to power the pneumatics for foil press number 6 was not turned off and locked out while an employee was sharpening the dies under the ram, exposing the employee to crush/amputation hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.147(c)(7): The employer shall provide training to ensure that the purpose and functions of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees: a) D&W Fine Pack - On or about April 19, 2016, an employee (machine operator) who was performing maintenance work with their arms in the ram area on foil press number 6 did not receive training in the recognition of the applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control, exposing the employee to crush/amputation hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by: a) D&W Fine Pack - On or about April 19, 2016, an employee operating Straw Machine number 8 was exposed to in-running nip points from the straw carrier portion of the machine, exposing the employees to laceration/amputation hazards. b) D&W Fine Pack - On or about April 19, 2016, an employee operating Straw Machine number 9 was exposed to in-running nip points from the straw carrier portion of the machine, exposing the employees to laceration/amputation hazards. c) D&W Fine Pack - On or about April 19, 2016, an employee operating Foil Press number 5 was exposed to an in-running nip point between a rotating shaft and stationary piece of sheet metal at the end of the takeoff conveyor, exposing the employee to laceration/amputation hazards. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative controls were not utilized: a) D&W Fine Pack - Foil Department - On or about April 19, 2016, a Machine Operator for foil press number 6, was exposed to noise at 158.7% of the exposure level of 90 dBA or an eight-hour time weighted average of 93.3 dBA. This exposure was observed over a 450 minute sampling period, with a zero noise exposure assumed for the 30 minutes not included in the sample. b) D&W Fine Pack - Foil Department - On or about April 19, 2016, a Utility 2 employee working at foil press number 5, as exposed to noise at 147.1% of the exposure level of 90 dBA or an eight-hour time weighted average of 92.7 dBA. This exposure was observed over a 434 minute sampling period, with a zero noise exposure assumed for the 46 minutes not included in the sample. c) D&W Fine Pack - Foil Department - On or about April 19, 2016, a Maintenance employee working in the foil department around various foils machines, such as #5 and #6, was exposed to noise at 169.8% of the exposure level of 90 dBA or an eight-hour time weighted average of 93.8 dBA. This exposure was observed over a 434 minute sampling period, with a zero noise exposure assumed for the 30 minutes not included in the sample. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
