29 CFR 1910.1030(c)(1)(v): An employer, who was required to establish an Exposure Control Plan did not solicit input from non-managerial employees responsible for direct patient care who were potentially exposed to injuries from contaminated sharps in the identification, evaluation, and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control Plan:      a) Worksite, on or about January 6, 2016 - The Jefferson Hospital Infection Control Manual Bloodborne Pathogen Exposure Control Plan and Related Policies did not include documentation of non-managerial direct patient care employees who offered solicitation on the evaluation and selection of effective engineering and work practice controls to eliminate or minimize existing exposures.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employee exposure:    a) Nuclear Medicine Department, on or about January 6, 2016 -  Employees provided injections with Precision Glide BD Sub Q 26G 5/8 needle which was not equipped with a safety shield.      b) Central Services Department, on or about March 28, 2016 - Equipment such as but not limited to forceps and clamps were not used to eliminate or minimize the need to manually handle reusable sharps and instruments during sorting, pre-soak and cleaning of soiled surgical equipment.

29 CFR 1910.1030(d)(3)(i): When there was occupational exposure, the employer did not provide, at no cost to the employee, appropriate personal protective equipment such as, but not limited to, gloves, gowns, laboratory coats, face shields or masks and eye protection, and mouthpieces, resuscitation bags, pocket masks, or other ventilation devices:    a) Perioperative Area Operating Room, on or about February 4, 2016 - Environmental service employees handled bloodborne pathogen biohazards waste bags from operative procedures that have the potential to leak.  Employees were not provided appropriate personal protective equipment such as face shield and/or safety glasses, and gown during handling of biohazard bags.

Needle holders were not used.     Engineering controls, such as needle holders, and particular work practice controls, such as hands free zones were not implemented.

An Environmental service employee cleaned the room and was stuck with the contaminated sharp not discarded in a sharps container.
