29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. (a) Lucas Merino Roofing, 819 South Raritan Street, Denver, CO: On or about November 12, 2015, Lucas Marino Roofing did not ensure frequent and regular inspections of the worksite were conducted by a "competent person" to ensure the use of fall protection prior to allowing employees to work on a 3/12 pitch roof. Condition exposed employees to a fall hazard of approximately 8 feet while removing and installing new composite roof shingles. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter). OSHA defines a "competent" person as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

(a) Lucas Merino Roofing, 819 South Raritan Street, Denver, CO: On or about November 12th, 2015, Lucas Merino Roofing did not ensure employees removing and installing new composite shingles on a 3/12 pitch roof were utilizing appropriate fall protection. Condition exposed employees to a fall hazard of approximately 8 feet. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).
