29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested.  On or about 01/4/2016 and times prior thereto, employees working at the Department of Veterans Affairs Medical Center located at 800 Zorn Ave in Louisville, KY were exposed to respiratory hazards (including but not limited to eye, skin, respiratory irritants, and TB), and the employer did not ensure all employees were fit-tested annually.   Notice #2, Item #11, 29 CFR 1910.134(f)(2) as required by 29 CFR 1960.8(b): The employer failed to conduct annual respirator fit testing.  The employer was cited for a violation of the (Same/Similar standard and/or Same/Similar hazard) on 8/10/2015, Inspection #1034563, date 12/4/2015 of final order/settlement, and means of abatement  Notice #1, Item #2, 29 CFR 1910.134(f)(2) as required by 29 CFR 1960.8(b): The employer failed to conduct annual respirator fit testing. 29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.  a) On or about 1/4/2016, employees working at the Department of Veterans Affairs Medical Center located at 800 Zorn Ave in Louisville, KY were exposed to hazardous materials (including but not limited eye, skin, and respiratory irritants) to which the employer had not compiled a complete list of the hazardous chemicals used in the work place.   Notice #2, Item #25, 29 CFR 1910.1030(c)(1)(iv), as required by 29 CFR 1960.8(b): The employer failed compile a complete list of hazardous materials used by employees on site.  The employer was cited for a violation of the (Same/Similar standard and/or Same/Similar hazard) on 8/10/2015, Inspection #1034563, date 12/4/2015 of final order/settlement, and means of abatement.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v).  a) On or about 01/4/2016 at times prior to, employees working at the Department of Veterans Affairs Medical Center located at 800 Zorn Ave in Louisville, KY were exposed to hazardous materials (including but not limited eye, skin, and respiratory irritants) to which the employer had not properly labeled the chemical containers in the following areas:  1. Grounds building, unlabeled white plastic container;  2. Paint shop, unlabeled paint cans.  Notice #1, Item #3, 29 CFR 1910.1200(f)(5)(i), as required by 29 CFR 1960.8(b): The employer failed to ensure each container in the workplace was properly labeled.  The employer was cited for a violation of the (Same/Similar standard and/or Same/Similar hazard) on 8/10/2015, Inspection #1034563, date 12/4/2015 of final order/settlement, and means of abatement. 29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical.  a) On or about 01/4/2016 and at times prior to, employees working at the Department of Veteran Affairs Medical Center (located at 800 Zorn Ave Louisville, KY) were exposed to various hazardous materials in which the employer did not have safety data sheets for as follows:   1. Engineering shops had used Worthington Map Gas and acetylene compressed gas (eye, skin, respiratory irritants) for welding/soldering;   2. Paint Shop employees use Top Gun 200 Silicone and Rotanium Cleaner (irritants),   3. Grounds employees use gasoline for lawn equipment (irritant, flammable);    4. Prosthetics use Bargee Cement (irritant) and E206 Silicone (irritant);   5. Research use sodium sulfate and magnesium chloride   Notice #1, Item #4, 29 CFR 1910.1200(g)(8), as required by 29 CFR 1960.8(b): The employer failed to  maintain in the workplace copies of the required safety data sheets for each hazardous chemical .  The employer was cited for a violation of the (Same/Similar standard and/or Same/Similar hazard) on 8/10/2015, Inspection #1034563, date 12/4/2015 of final order/settlement, and means of abatement. 29 CFR 1910.134(c)(1): The employer did not ensure that a written respiratory protection program with worksite-specific procedures was established and implemented to include the provisions of (i)-(ix), as applicable.  a) On or about 1/4/2016 employees working at the Department of Veteran Affairs Medical Center located at 800 Zorn Ave in Louisville, KY were using respirators for which the employer has a written respiratory protection program but the program does not contain proper selection criteria per paragraph 1910.134(c)(1)(i).  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
