On or about January 13, 2016, at the northeast side of the rooftop, employee operating Bostitch pneumatic nail gun to perform roofing work was not wearing eye protection, exposing him to being struck by flying debris or nails.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Employees performing roofing work from steep pitch roof are not being protected from 9 feet 8 inches fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on January 13, 2016, when employees were installing shingles on the roof of a one-story residence at 13635 Mandarin Road, Jacksonville, Florida 32223 without fall protections and were exposed to fall hazards of 9 feet 8 inches above the surrounding ground. Rogero & Williams Roofing Contractors, Inc. previously committed a Repeat violation of this standard on September 16, 2015, when employees were performing roofing work at 12808 Quincy Dr., Jacksonville, Florida 32224, which became a Final Order on October 13, 2015. (Inspection No. 1092339).
