29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a. Employees installing roofing shingles at elevations of six feet or more above the ground are not being protected from fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on April 6, 2016, when employees installing roofing shingles on a 6:12 pitch at 5185 Datil Pepper Road, in St. Augustine, FL 32086 were exposed to an 8 feet fall hazard above the ground in that they did not have a fall protection system installed. Rogero & Williams Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1092339, citation number 01, item number 002 and was affirmed as a final order on October 13, 2015, with respect to a workplace located at 12808 Quincy Drive, Jacksonville, FL 32224.
