29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or are likely to be present, which necessitated the use of personal protective equipment (PPE):  (a) Pool Equipment Closet - The employer did not perform a personal protective equipment hazard assessment of the workplace, and employees had exposure to hazards, including, but not limited to, splash hazards when employees used Ecolab Aqua Balance Muriatic Acid (a corrosive that can cause severe eye burns) to maintain the hotel swimming pool, on or about January 8, 2016.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  (a) Pool Equipment Closet - Employees used Ecolab Aqua Balance Muriatic Acid (a corrosive that can cause severe eye burns) to maintain the hotel swimming pool, and the establishment had no emergency eyewash, on or about January 8, 2016.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(g)(1): The employer did not have a safety data sheet for each hazardous chemical in use:   (a) Pool Equipment Closet - Employees dispensed hazardous chemicals, including, but not limited to, Ecolab Aqua Balance Muriatic Acid, to maintain the water in the hotel swimming pool.  The Ecolab Aqua Balance Muriatic Acid contained hydrochloric acid, a corrosive that can cause severe skin burns and eye damage, and the employer did not have the safety data sheet in the workplace for this and other hazardous chemicals used in the Pool Equipment Closet, on or about January 8, 2016.   New Cumberland Hospitality, Inc., dba Clarion Hotel and Conference Center was previously cited for a violation of this Occupational Safety and Health Standard 1910.1200(g)(1), which was contained in OSHA inspection number 1063666, citation number 1, item number 1b and was affirmed as a final order on September 22, 2015 with respect to the workplace located at 148 Sheraton Drive, New Cumberland, Pennsylvania  17070.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
