29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) 1470 Taylor Road, Montgomery AL; On or about January 12, 2016 and at times prior; the controlling employer The Stewart/Perry Company, Inc. failed to ensure that it's subcontractor MMC Construction, LLC protected it's employees from fall hazards of up to 13.7 feet to the ground below in that employees were allowed to climb up the side of the scaffold without the use of a ladder or other means of safe access.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms. a) 1470 Taylor Road, Montgomery AL; On or about January 12, 2016 and at times prior; the controlling employer The Stewart/Perry Company, Inc. failed to ensure that it's subcontractor MMC Construction, LLC protected it's employees from fall hazards of up to 13.7 feet to the ground below in that employees were working from the second level of a three buck high scaffold without guardrails along all open sides and ends of the platforms.
