29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Cut bench on front side, new townhome construction located at 2040 Bolton Drive, Atlanta, GA 30318. Employee was exposed to eye injuries while operating a Makita (Model 5007F) 7-1/4-inch Circular Saw without protective eyewear. The employee was exposed to fiber cement particles and wood debris while using this equipment without safety glasses.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Lower roof, new townhome construction located at 2040 Bolton Drive, Atlanta, GA 30318: Employee was exposed to falls of approximately 9-feet, 6-inches to the lower level while installing Hardie-Plank Siding from a 4/12 pitched roof with no fall protection system in place.  (b) Upper roof, new townhome construction located at 2040 Bolton Drive, Atlanta, GA 30318: Employee was exposed to falls of approximately 19-feet, 6-inches to the lower level while engaged in siding activities on a 8/12 pitched roof without connecting his full body harness to the life-line provided.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  (a) Front side, new townhome construction located at 2040 Bolton Drive, Atlanta, GA 30318: The employer failed to remove a damaged portable ladder from the site as it had broken rungs, and bent side rails. The damaged ladder used to access the roof was not tagged or removed from service.
