OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in hazards created by rotating and other moving parts of the conveyors and their components:    (a) On or about 1/20/16, employees including, but not limited to, production employees and sanitation techs who worked alongside the inclined conveyors that spanned two floors, were exposed to caught-in hazards created by rotating and other moving parts of the conveyors and their components.

29 CFR 1910.219(c)(2)(i): All exposed part(s) of horizontal shafting seven (7) feet or less from floor or working platform were not protected by stationary casing(s) enclosing shafting completely or by trough(s) enclosing sides and top or sides and bottom of shafting as location required:  (a) The shaft that projected 5 inches out of the Boston Gear worm gear 60:1 speed reducer (#SSHF726-60KB5HS1P23, s/n 140805030-1485) gearbox on line 4 was not protected and was less than 7 feet from the work platform, exposing employees to a caught-in hazard created by the rotating shaft; on or about 1/20/16.

29 CFR 1910.219(c)(4)(i): Unguarded projecting shaft end(s) did not present a smooth edge and end and projected more than one-half the diameter of the shaft:  a) main building, line 4, the end of the 1-3/8 inch diameter shaft that projected 5 inches out of the Boston Gear worm gear 60:1 speed reducer (#SSHF726-60KB5HS1P23, s/n 140805030-1485) gearbox did not present a smooth edge and end in that there was a 3/8-inch wide by 1/4-inch deep notch that ran along the entire length of the unguarded shaft to the end, exposing employees to a caught-in hazard created by the rotating shaft; on or about 1-20-16.  (b) main building, line 4, Boston Gear worm gear 60:1 speed reducer (#SSHF726-60KB5HS1P23, s/n 140805030-1485) - the 1-3/8 inch diameter shaft projected more than one-half its diameter, in that, it projected 5 inches; on or about 1/20/16.
