OSH Act of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to fall and crushing hazards. The employer is failing to protect employees from fall and crushing hazards while using personnel platforms elevated by all-terrain forklifts. Employees are being elevated using a SKYTRAK Type MS-T 3045 Serial 6042 Model All-Terrain Forklift and a 4 foot by 16 foot platform. In accordance with ANSI B56.6 2002, the platform dimensions are not to exceed the axel base by more than 10 inches and in this case, the platform extended 32 inches past the allowable limits on each side of the forklift. This creates an issue of instability for the forklift when the platform is elevated which could cause the lift to tip or become unsteady enough to cause an employee to fall. Among other methods, feasible and acceptable methods of abatement are: a) Ensure that all employees involved in the operation are trained and briefed prior to working with this equipment of the hazards involving elevating employees and stability issues involving this piece of equipment. b) Ensure that all employees of the company follow both the manufacturers recommendations in the operators manual and follow the ASME/ANSI B56.6 2002 Safety Standard for Rough Terrain Forklift Trucks. c) Ensure the platform being used by the company meets the requirements of both the manufacturers requirements and the above listed ANSI Standard.

Worksite located at 20511 Yort St. Elkhorn NE: The employer failed to ensure a complete guardrail system was installed on a platform supported by a forklift prior to allowing employees to work. In this case employees were exposed to a fall of approximately 12 feet to the ground level below while utilizing the platform to cut and measure OSB for roof sheathing.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of �1926.502(k) developed and implemented. Worksite located at 20511 Yorst St Elkhorn, NE 68022; a residential structure: Employees were observed working on residential structure performing framing activities without any type of fall protection system in use. This exposed the employees to falls in excess of 10 feet.
