29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: The employer is failing to notify employees of modifications and/or additions which may affect the safe operations of the TCM PRO-CG 25 propane fueled forklift, S/N: VFHM480-49M. Most recently, on or about 1/23/2016, at 704 W. Park Road, Union, Missouri, employees were using the TCM PRO-CG 25 propane fueled forklift with a man basket without the manufacturer's written approval. Maintenance employees utilized the addition to change light bulbs throughout the facility. This condition exposed employees to fall hazards.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle: The employer is failing to prevent employee exposure to point of operations hazards. Most recently, on or about 2/4/2016, at 704 W. Park Road, Union, Missouri, point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle of the following: 1) The 1880 Extrusion Press Machine, Model: 1880 US Ton, S/N: 13107, the power saw blade guard left the blade exposed approximately 9" at the point of operation. 2) The Oliver Power Saw, Model: 94-DHZ, S/N: 96134, the power saw blade guard left the blade exposed approximately 3.5" at the point of operation. 3) The Oliver Power Saw, Model: 94-DHZ, S/N: 97087, the power saw blade guard left the blade exposed approximately 3.5" at the point of operation.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables were not connected to devices and fittings so that strain relief was provided that would prevent pull from being directly transmitted to joints or terminal screws: The employer is failing to prevent employee exposure to all electrical flexible cords and cables hazards. Most recently, on or about 2/4/2016, at 704 W. Park Road, Union, Missouri, workers were exposed to electrical hazards where flexible cords and cables were not connected to devices and fittings that strain relief was provided to prevent pull from being directly transmitted to joints or terminal screws: 1) The power cord for a 480V Bagley Floor Blower fan, approximately 48 inches high from floor level, the power tap was not connected so that strain relief would prevent pull from being directly transmitted to joints or terminal screws. 2) A 110v Sand Blaster, Make, Model & S/N is unknown, the power tap was not connected so that strain relief would prevent pull from being directly transmitted to joints or terminal screws.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: In the Alternative of 29 CFR 1910.23(c)(1): The employer is failing to protect employees from fall hazards. Most recently, on or about 1/23/2016, at 704 West Park Road, Union, Missouri, employees were exposed to a fall hazard while on top of the Paint Line Washer Dry-Off Oven, approximately 16 feet 5 inches above the next lower level without the use of fall protection. While on top of the oven, the employees attempted to install a 6 feet by 5 feet steel metal sheet and an Industrial Air Products Exhaust Fan, Model: 11-10RB, S/N: 150291-1, an employee sustained a fatal injury when he fell to the concrete floor below.
