OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: Loop 1604 & Shaenfield Rd; Komatsu Excavator, Model PC200LC-8, SN: A90334: On or about January 25, 2016 and at times prior thereto, employee(s) were exposed to struck-by hazards from the excavator and falling loads, while lifting concrete coping blocks with the excavator that was not configured to the manufactures lifting conditions.
