29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). At the jobsite located 406 Industrial Drive, Maryland Heights, Missouri, the employer did not ensure each powered industrial truck operator had completed the required training prior permitting them to operate powered industrial trucks. Two employees were operating powered industrial trucks without required training certification.

The following defective forklifts were on site: 1. Hyster Forklift, Model Number: S60XM; Serial Number: D187V17973X was operated with a horn that did not work. 2. Caterpillar Forklift, Model Number: DP70; Serial Number: T20C-61499 was operated with tires that need to replaced because of missing tread.
