29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      On or about 01/27/16, at the Hardwood Manor Apartments, under construction and located on 3150 Church Street, in Caledonia, New York, fall protection was not in use while employees were exposed to unprotected sides and edges 20 feet above ground level.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a rigid support and a grasping device, such as a grab rail, provided to assist the employee in mounting and dismounting the ladder:        On or about 01/27/16, at the Hardwood Manor Apartments, under construction and located on 3150 Church Street, in Caledonia, New York, a portable extension ladder was in use and did not extend 3 feet above the landing where employees dismounted and the ladder was not secured to the top landing.    NO ABATEMENT CERTIFICATION REQUIRED
