29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds) per employee: a) On 01/04/19 on an apartment building construction site at 4410 North French Road, East Amherst, NY: An employee was standing on the second floor wall while engaged in setting roof trusses. The employee was utilizing a personal fall arrest system anchored to a roof truss. The roof truss was blown down by a gust of wind. The employee fell approx. 9 ft. 1 inch to the level below and suffered a serious injury. Two other employees tethered to the truss(s) also jumped or fell. The anchorage point used for the attachment of the personal fall arrest equipment used by the employees was not capable of supporting at least 5000 pounds. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could neither free fall more than 6 feet (1.8 m), nor contact any lower level: a) On 01/07/19 on an apartment building construction site at 4410 North French Road, East Amherst, NY: An employee was walking and standing on the second floor wall in between the roof trusses on the front side of the building. The employee was utilizing a personal fall arrest system, that was rigged with excessive slack in the lifeline which would allow the employee to free fall more than 6 ft. if he fell to the outside of the building and also to contact the floor if the fall was to the inside of the building. The fall distance to the ground on the outside of the building was approx. 18 ft., and the fall distance to the floor on the inside of the building was approx. 9 ft. 1 inch. NO ABATEMENT CERTIFICATION REQUIRED
