OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: a) E. Ridgely Street (Atmore, AL); On or about January 28, 2016 and at times prior thereto, the employer exposed employees to struck-by hazards in that employees were permitted to operate a Volvo brand double-drum vibratory asphalt compactor without wearing a seatbelt.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Mobile jobsite; On or about January 28, 2016 and at times prior thereto, the employer failed to train employees who operate a Volvo brand double-drum vibratory asphalt compactor in the safe operation of the equipment which would have ensured these employees had knowledge of including but not limited to equipment controls, safety features, and loading and unloading procedures. ********************************************************************** **Or in the alternative: OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: a) Mobile jobsite; On or about January 28, 2016 and at times prior thereto, the employees were exposed to crush and struck-by hazards from loading a Volvo brand double-drum vibratory asphalt compactor onto a trailer in an unsafe manner in that the employee did not use a signalman, used a ramp of inadequate width and did not approach the ramp at the appropriate angle.
