OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) Road Widner, near Atmore, AL: On January 25, 2019, and at times prior, the employer exposed employees to slip/trip, amputation and crushed-by hazards in that the employer failed to ensure that employees working from or near the conveyor portion of the road widener were protected from accidental startup of the conveyor

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. a) Road Widner, near Atmore, AL: On January 25, 2019, the employer had an employee get his foot stuck in the discharge area of the Ingersol-Rand Blaw-Knox RW-195D Road Widener resulting in a fracture to the left ankle, requiring hospitalization. The employer failed to report the work-related hospitalization to OSHA within twenty-four (24) hours.
