29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 dBA: Employees engaged in pallet building activities were exposed to noise hazards in that the employer had not implemented a hearing conservation program. 1) An employee working in the pallet assembly area was exposed to a recorded personal noise dosimeter sound level of 89.5 decibels during the 439 minutes sampling period on February 8, 2016. 2) An employee operating the re-saw was exposed to a recorded personal noise dosimeter sound level of 88.8 decibels during the 455 minutes sampling period on February 5, 2016. 3) An employee working as the lead for the re-saw was exposed to a recorded personal noise dosimeter sound level of 88.6 decibels during the 454 minutes sampling period on February 5, 2016.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). Employees engaged in pallet building activities were exposed to safety and health hazards in that the employer had not conducted a hazard assessment for each workstation to determine hazards present which necessitate the use of PPE.
