29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. On or about January 30, 2016 at or near 8200 Frazier Pike, Little Rock, AR 72206, a forklift operator dismounted the forklift without the load engaging means fully lowered. This condition exposed employees to the hazard of being struck-by or caught-in between the suspended load and the concrete floor.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about January 30, 2016 at or near 8200 Frazier Pike, Little Rock, AR 72206, employees were operating a forklift that was not examined daily. A daily examination could eliminate forklift accidents that may expose employees to hazards such as struck-by or caught-in between.
