29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) On February 9, 2016, American Louver Company, Skokie IL, did not provide their employees, including contracted workers, hazard communication training on hazardous chemicals they work with and are exposed to in their workplace, such as crystalline quartz silica, a known human carcinogen, which is contained in the silica sand used to fill hollow plastic bases of construction barricades: The hazard communication training must include the following elements specified in 29 CFR 1910.1200: · The requirements of the Hazard Communication Standard; · The hazardous chemicals in their work area, and the operations in the work area where hazardous chemicals are present; · The physical (i.e., flammable, combustible, oxidizing, reactive, etc.) and health hazards (i.e., carcinogenicity) of the chemicals in the work area, and the measures employees can use to protect themselves, such as work practices, housekeeping, personal protective equipment (PPE) to be used, and emergency procedures; · The methods and observations used to detect the presence or release of a hazardous chemical in the work area; · The labeling system and the Safety Data Sheets (SDSs), and how the workers can obtain and use the appropriate hazard information; · The location and availability of the Safety Data Sheets (SDSs). b) On February 9, 2016, American Louver Company, Skokie IL, did not provide employees the required training on the revised elements of the Hazard Communication Standard for labels (e.g., pictograms and signal words) and the new format of the Safety Data Sheet (SDS) (i.e., section changes & section order and types of information contained within each section of the SDS), which was due December 1, 2013. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s): a) On February 3, 2016, American Louver Company, Skokie, IL, did not ensure safety data sheets (SDS), including the SDS for US Silica, Silica Sand (contains crystalline quartz silica), a known human carcinogen, were readily available and accessible during each shift to workers when they were in their work area(s). Exposed employees, including contract workers, used the silica sand to fill the hollow plastic bases of construction barricades. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
