OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  The employer is failing to ensure that all employees use fall protection on top of a railcar/rolling stock, which is known to be a fall hazard. Employees were exposed to physical harm such as a fall due to working on top of railcars while loading them without using fall protection devices.  This occured most recently on February 3, 2016 at 2310 Ohio St., Omaha, Nebraska 68110  Rail Yard.

29 CFR 1904.29(b)(1): A Log of all recordable work-related injuries and illnesses (OSHA Form 300 or equivalent), was not completed in the detail as required by the regulation:    The employer did not ensure that the OSHA Form 300 for the calendar year of 2016 were completed as required by the regulation to include, but not limited to:    Ankle Sprain - Object/substance that directly injured or made person ill was not described.    Abatement certification is required for this violation.  Abatement certification sheet is enclosed with the citation.
