OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls in excess of four feet from the gap and sides of extendible flatbed trailers within the manufacturing facility. On or about 12/17/2015, and at times prior in the facility at 550 Cheshire Road, Pittsfield MA, 01201, employees performing manufacturing activities on precast and prestressed concrete components consisting of finishing, quality control, and similar manufacturing related activities while standing on the decks of extensible and non-extensible trailer beds were exposed to fall hazards in excess of 4 feet from the unprotected gaps in the deck of the trailer and sides of the trailers. These manufacturing activities are distinguished from the process of : 1) loading or unloading raw materials from trailers to forming beds, or (2) loading or unloading finished precast or prestressed components onto and off of trailers where manufacturing activities are not being performed on the product while it is on the trailer. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to: the use of a portable flatbed truck mounted guardrail fall protection system.
