29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). On 2/3/16, at the Gainesville facility, the employer did not perform an arc flash assessment to determine what personal protective equipment would be appropriate for protecting employees that were required to work on energized 480 volt circuits. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.333(c)(2): The employer did not ensure that only qualified persons were working on energized circuits and that qualified persons were familiar with the proper use of special precautionary techniques, personal protective equipment, insulating and shielding materials, and insulated tools. On 2/3/16, at the Gainesville facility, the employer allowed an employee to work on an energized electrical panel who did not meet the qualified person requirements of being capable of working safely on energized circuits, being familiar with the proper use of special precautionary techniques, and the use of insulated tools as evidenced by the employee creating an arc flash incident when he did not know the line side from the load side of a main disconnect breaker.

29 CFR 1910.333(b)(2)(ii)(A): Safe procedures for de-energizing circuits and equipment were not determined before circuits and equipment were de-energized. On or about 11/11/2015, Maintenance Manager, Ray Mygrant performed maintenance work (ohm out) inside a 480 volt panel associated with the DAF unit in waste water treatment without using a written LOTO procedure to ensure that a lock placed on an upstream panel would be effective.
