29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a)  STS Management, Inc. on or about February 08, 2016, at the address of 420 Madison Ave., Toledo, OH:  The employer failed to ensure an employee performing a site inspection/evaluation of HVAC controls at the aforementioned address was adequately protected from a fall by ensuring the use of appropriate fall protection equipment. The employee performing these task in a confined space (Air Handler #1) in which maintained a unprotected edge to a lower level, was exposed to an approximant 7.5 ft. fall to concrete surface below.

29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces:    a)  STS Management, Inc. on or about February 08, 2016, at the address of 420 Madison Ave., Toledo, OH: The employer failed to take effective measures to ensure that employees who are not expected to enter a permit entry confined space avoid theses spaces by effectively evaluating the workplace and informing affected employees of the location and hazards contained within, prior to work commencing. Due to this condition, an employee performing an inspection/site survey of ventilation sensors in a permit confined space was exposed to unexpected energization of forced air systems and fall hazards.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a) STS Management, Inc. on or about February 08, 2016, at the address of 420 Madison Ave., Toledo, OH: The employer failed to ensure an energy control program consisting of control procedures, employee training and periodic inspections were developed and performed. An employee performing a site survey/inspection in the Air Handler #1 compartment without the benefit of energy isolation of the forced air blowers, hazardous energy recognition training and employer evaluation, exposed the employee and outside servicing personnel to potential entrapment and fall hazards in the event of unexpected blower startup.
