29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.    A) STS Management Inc. on or about June 29, 2018 at the address of 801 Jefferson Avenue, Toledo, OH: The employer did not ensure employees were protected from head injuries while working below an elevated dumpster while employees were throwing out debris during gut rehab operations. Due to this condition, employees were potentially exposed to impact injuries caused from falling material and/or equipment.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    A) STS Management Inc. on or about June 29, 2018 at the address of 801 Jefferson Avenue, Toledo, OH: The employer did not ensure that an employee operating a fork truck was adequately trained. Employees working near or around the untrained operator were exposed to struck-by injuries in that the operator left the fork truck unattended and elevated above the entry and exit point of the building under construction.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute (ANSI) B56.1-1969, Safety Standards for Powered Industrial Trucks.  A) On or about June 29, 2018, at the address of 801 Jefferson Avenue, Toledo, Oh: The employer did not ensure employees were kept from passing underneath an elevated load and/or ensure the load engaging means was fully lowered before leaving the fork truck unattended, as specified in ANSI B56.1-1969. Employees operating in these conditions were exposed to struck by hazards when walking under the elevated dumpster positioned on the forks.

29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system. Note:  If a guardrail system was chosen to provide the fall protection, and a controlled access zone had already been established for leading edge work, the control line may be used in lieu of a guardrail along the edge that parallels the leading edge.    A) STS Management Inc. on or about June 29, 2018, at the address of 801 Jefferson Avenue, Toledo, OH: The employer did not ensure employees tasked with the installation of floor decking were protected from a 8 foot fall to the level below. At least one employee was conducting work outside of the decking zone without the benefit of fall protection.
