OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:           a.)    Mattocks Five, Inc. dba Albion Mill, 73 Canal Street, Albion, PA  16401, second floor area, on or about February 10, 2016 and times prior thereto:  The employer failed to provide a place of employment free from a recognized hazard in that, employees were exposed to a fall hazard associated with the lack of filler blocks in between the rungs/cleats of wooden ladders.  Ladders were used for activities including, but not limited to, accessing the 2nd floor catwalk, and entry/exit into grain bins.  Ladders were present in areas that included, but were not limited to:       1.  2nd floor access to the catwalk platform and,       2.  Entry and exit access points into grain bins onsite.

Mattocks Five, Inc. dba Albion Mill, 73 Canal Street, Albion, PA  16401, second floor area-bin access area, on or about February 10, 2016 and times prior thereto:  Employees were exposed to fall hazards of approximately 7.7 feet while accessing various bins on the 2nd floor.  Entry and exit access openings of the bins were not protected by a guardrail or similar in order to protect employees from falling into the bins.

29 CFR 1910.272(g)(2): When entering the grain handling facility bins, silos, or tanks from the top, employees did not wear a body harness with lifeline, or use a boatswain's chair that met the requirements of Subpart D, 29 CFR 1910.28(j)(a):        a.)  The employer does not require employees to use a body harness with a lifeline, or boatswain's chair when employees are entering grain storage structures from a level at or above the level of the stored grain. This violation was most recently observed in grain handling bins located at 73 Canal Street, Albion, PA on or about, February 10th, 2016 where employees performing bin entry operations were not protected from engulfment hazards by the use of a body harness with lifeline, or boatswain's chair.  To abate this ongoing violation, the employer must provide and require the use of a body harness with lifeline, or boatswain's chair that meets the requirements of subpart D of this part.           The Mattocks Five, Inc. dba Albion Mill was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.272 (h)(2)(i), which was contained in OSHA inspection number 924399, citation number 1, item number 6 and was affirmed as a final order on June 23rd, 2014, with respect to a workplace located at 73 Canal Street, Albion, Pa 16401.
