OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to a struck-by hazard associated with a collapsing storage rack.     a) On or about 2/17/2016, on the west side of the warehouse, the employer allowed employees to operate forklifts and access walkways near storage racks with missing anchor bolts.    b) On or about 2/17/2016, in the palletizing area, the employer allowed employees to operate forklifts and access walkways near storage racks with missing anchor bolts and damaged columns.

29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening:    a) On or about 2/17/2016, in the basement pit area, the employer allowed employees to check on equipment and conduct housekeeping and did not ensure that the ladderway floor opening was guarded with standard railing.
