Employee was operating a Milwaukee Heavy Duty corded Grinder/Sander, sanding plywood decking while not wearing any eye and or face protection exposing him to eye and face injuries from flying debris. Condition occurred on or about 02/17/16. Mega Contractors Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1082924, citation number 1, item number 1 and was affirmed as a final order on 01/12/16, with respect to a workplace located at 601 Chamberlain Avenue, Perth Amboy, NJ 08861.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented: a) 657 Chamberlain Avenue, Perth Amboy, NJ 08861, Building 3, Westside. Employee was installing a new ledger board, residential construction, on the face of the building while standing on planks elevated by temporary handrails exposing him to fall hazards of approximately 14 feet to the ground below with no fall protection systems in place. b) 657 Chamberlain Avenue, Perth Amboy, NJ 08861, Building 3, Southside. Employee was working on and from a new balcony approximately 12 foot 6 inches from the platform to the ground below with no fall protection system in place. Condition occurred on or about 02/17/16. Mega Contractors Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1082924, citation number 1, item number 2 and was affirmed as a final order on 01/12/16, with respect to a workplace located at 601 Chamberlain Avenue, Perth Amboy, NJ 08861.
