OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:         a.)  Embassy Powdered Metals, Inc., 70 Airport Rd, Emporium, PA 15834-Shipping department area-On or about February 18th, 2016 and times prior thereto:  The employer failed to provide a place of employment free from the recognized hazard of a struck-by hazard from potential accidental disengagement of a load due to a missing safety latch on a hook.  The hook was associated with a ½ Ton Coffing brand chain hoist (Model: ELC 1013-3; Serial # JL672SJ) in the Shipping Department area of the facility.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:       a.)  Embassy Powdered Metals, Inc., 70 Airport Rd, Emporium, PA 15834-Tumbling station/area-On or about March 3rd, 2016 and times prior thereto:  The employer did not institute a continuing and effective hearing conservation program when employees noise exposure exceeded an 8 hour time weighted average sound level of 85 dbA.  An employee performing tumbling operations, including but not limited to, tumbling/deburring of metal parts was exposed to noise at a level of 77.85 % of the allowable limit during a 440 minute sampling period on March 3rd , 2016; exposure calculations included a zero increment for the 40 minutes not sampled.  This exposure is equivalent to a sound level of 88.1 dBA for the dose and time of the employee exposure.
