29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about March 24, 2016, the employer did not administer an effective hearing conservation program that included noise monitoring, required use of suitable hearing protectors, training, audiometric testing, and recordkeeping for employees cycling the injection molders: An employee was exposed to continuous noise levels at 72.8-percent of the permissible daily noise exposure, or an equivalent sound level of approximately 87.9 dBA, during the 469-minute sampling period on March 24, 2016; exposure calculations include a zero increment of 11-minutes not sampled.
