OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards of (94 feet): a) Batch house - On or about February 14, 2016, an employee was trapped in an elevator when the elevator malfunctioned leaving him approximately 94 feet above ground level in subzero temperatures. The elevator emergency signal could only be heard in the vicinity below the elevator not manned by another employee. The employee self-rescued by exiting through the top of the elevator and was exposed to a fall hazard of 94'.

This injury further resulted in days away from work for this employee.
