Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard:  a) Lumber Department:  Employees were exposed to fall hazards as they had been standing on the forks of the forklift 6 or more feet above the floor to put up stock or to get stock down from the racks.  Among other methods, one feasible and acceptable means of abatement would be as follows:  1) Utilize only platforms designed for use in elevating personnel with forklifts.  These platforms must meet the requirements set forth in ANSI/ITSDF B56.1-2012 Safety Standard for Low Lift and High Lift Trucks Section 4.17 Elevating Personnel, and 7.37 Platforms: Elevating Platforms for elevating personnel shall have (a) a slip resistant floor surface, (b) a minimum floor space of 450 mm X 450 mm for each platform occupant. (c) protection for personnel in their normal working position on the platform from moving parts of the truck that represent a hazard. (d) restraining means such as a guard rail or a means for securing personnel such as a body belt or lanyard whenever the platform can be elevated to a height greater than 1 200 mm.  2) Utilize a stand up forklift with a harness and lanyard to access the racking.

29 CFR 1910.26(c)(2)(vii): 1910.26(c)(2)(7): Ladders having defects were not marked and taken out of service until repaired.  (a) Lawn and Garden: Employees were exposed to fall hazards as the Blue Louisville Steel Warehouse Rolling 10 foot Ladder in Lawn and Garden had a bent right front foot and a bent frame and was not taken out of service.   (b) Outdoor Lawn and Garden: The 6 foot Yellow Davidson Pro Ladder the spreaders were loose the tray was detached, and the Silver 6 foot Davidson Ladder the bottom step was damaged. Both Davidson Pro ladders were located in Outdoor Lawn and Garden, and they were not taken out of service.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  (a) Lumber:  Employees were exposed to struck by hazards as the Hyster 80 propane forklift had a bent load backrest with 2 uprights missing and the forklift had not been taken out of service until it was in safe operating condition.
