OSH ACT of 1970 Section (5)(a)(1):    The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazard of being struck by dock plate and or caught in between delivery trucks when using loading dock plate known to company as Blue Giant Model MD 7220 M  Serial Number 0002522. Capacity 20,000 LB Hinged dock plate.    (a)  The employer is failing to protect  employees  This was most recently documented on, or at dates prior to, October 14, 2016 at worksite 13013 E US Hwy 40, Independence Missouri.-employees working on loading dock were exposed to struck by and caught in between hazards when using a visibly damaged hinged dock plate known to company as Blue Giant Model MD 7220 M  Serial Number 0002522. Capacity 20,000 LB Hinged dock plate.     Among other methods, feasible and acceptable means of hazard abatement include:  (1) Inspect dock plate per general practices for safety and serviceability American National standard ANSI/ASC 2007 Standard for Specification for Dock Leveling Devices This standard defines safety performance and testing requirements with regard to design use and maintenance  To correct this hazard comply with the manufacturers instruction and ANSI 30.1 for dock leveling devices.   (2) Section 5.1.1  Requirements identified in section 5 shall apply to all dock leveling devices within the scope of this standard unless specific exclusions are stated.   (3) Section 5.1.2 Installation instruction recommend initial periodic inspection procedures. The manufacturer shall publish, provide intial purchaser and make the following information available to owners or their agents. Installation instruction, recommended initial and periodic inspections procedures. Maintenance procedures. Operating procedures. Description of specifications for replaceable or repairable parts. It shall be the responsibility of the owner or his agent to verify this material listed in this section has been received. and training of personnel entrusted with the installation, use or maintenance of dock leveling device.   (3) Section 5.1.3 Pertinent cautious and instruction markings for the operation and safety of the dock loading device shall be provided on durable labels. the labels shall be permanently affixed to the dock leveling device, control box if applicable and or near the dock leveling device.  (4) Section 5.2 Dock Face Mounted Leveling Devices. 5.2.1 If leveling device is to be operated manually, handholds or other lifting aids shall be provided. 5.4 The Owners Responsibility include the following.   (5) Section 5.4.4 Manufactures recommend periodic maintenance and inspection procedures, in affect at date of shipping shall be followed and written record of the performance of these procedures should be kept.   (6) Section 5.4.5 Dock leveling devices that are structural damaged or have experienced a sudden loss of support while under load. Such as might occur when a transport vehicle is pulled out from the dock leveling device, shall be removed from service, inspected by the manufacturer's authorized representative, and repaired as needed before being placed in service.   (7) Section 5.4.10 The dock leveler should never be used outside its vertical working range or outside the manufactures labeled rated capacity. It must also be compatible with the loading equipment and other conditions relating to the dock.

29 CFR 1910.23(a)(8):    Every floor hole into which persons could accidentally walk were not guarded:   (a) The employer is failing to protect employees  This was most recently documented on, or at dates prior to, October 14, 2016 at worksite 13013 E US Hwy 40, Independence Missouri.- employees working in Barn #3, on the second level were exposed to a fall hazard when exposed to multiple floor holes that were not protected by a gate , guardrail system, or cover of standard strength, to provide protection from falling through the opening. 29 CFR 1910.23(e)(3)(iv):    The anchoring of posts and framing of members for railings of all types were not of such construction that the completed structure was capable of withstanding a load of at least 200 pounds applied in any direction at any point on the top rail.  (a) The employer is failing to protect employees. This was most recently documented on, or at dates prior to, October 14, 2016 at worksite 13013 E US Hwy 40, Independence Missouri.- Employees working in Barn 1, were exposed to a fall hazard of approximately 12 feet when working next to guardrail system that was damaged by wood rot and incapable of supporting load of at least 200 pounds applied in any direction at any point on the top rail.   Abatement certification is required for this item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
