29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: a) Madison Concrete Construction, FMC Tower, Philadelphia, PA - The employer did not administer an effective hearing conservation program. An employee operating concrete pump truck (Putzmeister BSA 1400HP-D, #210102794) was exposed to sound levels which exceeded the permissible exposure limit of 90 dBA as an 8-hour Time Weighted Average. The employee employee exposure measured is equivalent to an 8-hour TWA of 98.87 dBA. Zero exposures was assumed for all unsampled time periods. Violation noted on March 10, 2016.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) Madison Concrete Construction, FMC Tower, Philadelphia, PA - The employer did not require employees operating the concrete pump truck (Putzmeister BSA 1400HP-D, #210102794) to wear personal protective equipment, such as noise reducing ear plugs, ear muffs, etc. to protect from exposure to noise. An employee was exposed to sound levels which exceeded the permissible exposure limit of 90 dBA as an 8-hour Time Weighted Average. The exposure measured is equivalent to an 8-hour TWA of 98.87 dBA. Zero exposures was assumed for all unsampled time periods. Conditions noted on February 10, 2016.
