29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the residential construction site located 15893 W. 163rd Street in Olathe, Kansas:  Employees engaged in framing activities were exposed to health hazards from dermal, ingestion, and inhalation exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to Grip Rite Subfloor Construction Adhesive.

A copy of the required safety data sheet for Grip Rite Subfloor Construction Adhesive was not maintained at the residential construction site.

Employees had not been provided with training or information regarding the hazardous chemicals with which they work.  Hazardous chemicals such as Grip Rite Subfloor Construction Adhesive were used at the residential construction site.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  At the residential construction site located at 15893 W. 163rd Street in Olathe, Kansas:  Employees engaged in residential framing activities were exposed to an electrical shock hazard.   The 110 VAC energized conductors on the male plug of the extension cord were exposed in that the plug was damaged. The extension cord provided power to the circular saws used at the construction site.

Strain relief was not provided for the male plug end of the 110 VAC extension cord providing power to the circular saws at the construction site.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  At the residential construction site located at 15893 W. 163rd Street in Olathe, Kansas:  Employees engaged in residential framing activities, using pneumatic nail guns, were exposed to struck-by hazards in that eye protection was not provided.   Vega Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1069545, citation number 1, item number 1 and was affirmed as a final order on December 11, 2015 with respect to a workplace located at Lot 37 Weatherby Subdivision 79TH PL, Kansas City, MO.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  At the residential construction site located at 15893 W. 163rd Terrace in Olathe, Kansas:  Employees engaged in residential framing activities, walking the top plates and engaged in roof sheeting, were exposed to fall hazards of approximately 8 feet from the top plate of the first level of the residence to the interior of the structure and approximately 17 feet to the exterior ground below in that fall protection was not utilized.    Vega Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1069545, citation number1, item number 2 and was affirmed as a final order on December 11, 2016, with respect to a workplace located at Lot 37 Weatherby Subdivision 79TH PL, Kansas City, MO.
