29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides. a) On March 3, 2016 located at 3745 Beechmont Ct. Cincinnati, OH 45226 (Jacob Brothers Heating & Air Conditioning) as a part of accessing Poster sign #5501 stage/platform employees worked without conventional fall protection adjacent to an unprotected side or edge of a platform atop a storage trailer to pull up a ladder from ground level to be further utilized to gain access to the upper stage/platform and were exposed to fall potentials in excess of 13 feet. b) On February 3, 2016 located at 3745 Beechmont Ct. Cincinnati, OH 45226 (Jacob Brothers Heating & Air Conditioning) employees who performed sign installation associated operations on lower front unprotected side or edge of Poster sign #5501 stage/platform accessed through the rear gap between the Poster sign and stage/platform assessing the stage/platform work area without conventional fall protection prior to installing the connector anchor hook and were exposed to fall potentials in excess of 25 feet.

Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a)On March 4, 2016 located at 3745 Beechmont Ct. Cincinnati, OH 45226 (Jacob Brothers Heating & Air Conditioning) employees performed sign installation associated operations on upper back unprotected side or edge of Bulletin sign #5502 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems allowed employee(s) to free/swing fall into angle bracing, columns or metal sign structure below. b) On March 4, 2016 located at 3745 Beechmont Ct. Cincinnati, OH 45226 (Jacob Brothers Heating & Air Conditioning) employees performed sign installation associated operations on upper back unprotected side or edge of Bulletin sign #5502 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems allowed employees to free/swing fall in excess of 10 feet and the cross arm strap was not protected from sheering/abrasions against the edge of the platform. c) On March 4, 2016 located at 3745 Beechmont Ct. accidental disengagement potentials in end edge stage/platform falls, exposing employees to falls in excess of 17 feet to the ground below. o) On April 18, 2016 located at intersection of Hopple and Henshaw, approximately 500 feet east of Colerain across the street from a Fifth / Third Bank address 3000 Henshaw, Cincinnati OH 45225 an employee performed sign installation associated operations on lower front unprotected side or edge of Jr. Poster sign #1257 & 1258 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems anchor hook being utilized was incompatible to its connection surface allowing accidental disengagement potentials in end edge stage/platform falls, exposing employees to falls in excess of 15 feet to the ground below. p) On March 9, 2016 located at1814 Powers Ct. Cincinnati, Oh 45223 (WAE Church) employees performed sign installation associated operations on upper back unprotected side or edge of Bulletin sign #1192 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems allowed employee(s) to free/swing fall into the roof or the structure, columns or metal sign structure below. q) On March 9, 2016 located at1814 Powers Ct. Cincinnati, Oh 45223 (WAE Church) employees performed sign installation associated operations on lower front unprotected side or edge of Bulletin sign #1192 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems allowed employee(s) to free/swing fall into the roof or the structure, side wall of lower structure or columns below. r) On December 23, 2015 located at 919 W North Bend Rd. Cincinnati, Oh 45224 (McDonalds) employees performed upper back sign installation access associated operations on Bulletin sign #3338 by crawling on hands and knees on top of both signs without conventional fall protection and were exposed to fall potentials in excess of 25 feet. s) On December 23, 2015 located at 919 W North Bend Rd. Cincinnati, Oh 45224 (McDonalds) employees performed sign installation associated operations on lower front unprotected side or edge of Poster sign #3337 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems anchor hook being utilized was incompatible to its connection surface allowing accidental disengagement potentials in end edge stage/platform falls, exposing employees to falls in excess of 13 feet to the ground below. v) On January 5, 2016 located at 874 Old Ohio 28 Milford, Oh 45150 (Milford Self Storage) employees performed upper back sign installation access associated operations on Bulletin sign #5285 by crawling over the top of Poster # 5286 to gain access to the stage /platform of Bulletin #5285 without conventional fall protection and were exposed to fall potentials in excess of 35 feet. w) On January 5, 2016 located at 874 Old Ohio 28 Milford, Oh 45150 (Milford Self Storage) employees performed upper back sign installation associated operations on Bulletin sign #5285 unprotected side or edge stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems allowed employee(s) to free/swing fall into lower columns, column tops, angle bracing between signs, metal sign structure or adjacent metal sign structure below. x) On January 5, 2016 located at 874 Old Ohio 28 Milford, Oh 45150 (Milford Self Storage) employees performed upper back sign installation associated operations on upper back unprotected side or edge of Bulletin sign #5285 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems allowed employees to free/swing fall in excess of 10 feet and the cross arm strap was not protected from sheering/abrasions against the edge of the platform. y) On January 5, 2016 located at 874 Old Ohio 28 Milford, Oh 45150 (Milford Self Storage) employees performed sign installation associated operations on lower front unprotected side or edge of Bulletin sign #5285 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment systems being utilized allowed employees cross arm strap and retractable lanyard to free/swing fall the against the edge of the platform and was not protected from sheering/abrasion z) On March 3, 2016 located at 874 Old Ohio 28 Milford, Oh 45150 (Milford Self Storage) employees performed sign installation associated operations on lower front unprotected side or edge of Poster sign #5286 stage/platform utilizing personal protective fall arrest equipment which was not used in a reliable condition in that fall arrest equipment system anchor hook being utilized was incompatible to its connection surface allowing accidental disengagement potentials in end edge stage/platform falls, exposing employees to falls in excess of 20 feet to the ground below. aa) On February 19, 2016 located in the back of a parking lot between 2325 & 2335 W.
