29 CFR 1910.178(c)(2)(vi)(a): Only approved power operated industrial trucks designated as EX shall be used in atmospheres in which combustible dust is or may be in suspension continuously, intermittently, or periodically under normal operating conditions, in quantities sufficient to produce explosive or ignitable mixtures, or where mechanical failure or abnormal operation of machinery or equipment might cause such mixtures to be produced. a) AQ Building: The employer failed to ensure that approved industrial equipment was utilized where combustible dust was utilized and/or handled. Employees were exposed to a fire/explosion hazard while performing duties involving the manufacture of a final AQ and operating a Clark industrial lift: CPC #652: serial # GX127E0067463455 and a Clark Industrial lift: CPC 646: serial # P3665L-05169398. A sample taken on March 08, 2016 and June 09, 2016 was determined to be CLASS II combustible dust.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. AQ (Anthraquinone) Building: The employer failed to ensure that all electrical equipment operated in the area was approved for a DIVISION 1, CLASS II location. Employees were exposed to a fire/explosion hazard while performing duties involving the manufacture of AQ (Anthraquinone). A sample taken on March 08, 2016 and June 09, 2016 was determined to be a Division I CLASS II explosive combustible dust. a) Portable or personal mechanical fans utilized were not approved for operation in DIVISION I, CLASS II location. b) The immersion heater on the Ethox Surfactant Tank was not approved for operation in a DIVISION I, CLASS II location.
