29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a.   On or about March 3, 2016, an employee operating a band saw to disassemble pallets at a facility located at 931 Millersville Ave. Howards Grove, WI 53083 was exposed to noise at 149.6% (noise dose) of the allowable noise dose of 50% during a sample period of 324 minutes during one shift on March 3, 2016.  149.62% is equivalent to an 8-hour TWA sound level of 92.9 dBA.    All provisions of 29CFR 1910.95(c) through (n) must be covered in a hearing conservation program.  Key elements include, but are not limited to the following:            1.  Noise level monitoring.      2.  Audiometric testing.      3.  Wearing of hearing protectors.      4.  Training program.      5.  Providing copies of standard to employees.      6.  Record keeping.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a.  On or about March 3, 2016, employees in the cutting area and nailing area at the facility located at 931 Millersville Ave. Howards Grove, WI 53083 were exposed to noise levels above the action level of 85 dBA and the employer did not establish and maintain an audiometric testing program for all employees exposed to noise at or above the 8-hour time weighted average of 85 dBA.

Information provided in the training program shall be updated to be consistent with changes in protective equipment and work processes.  a.  On or about March 3, 2016, employees at the facility located at 931 Millersville Ave. Howards Grove, WI 53083 working in the production area were exposed to sound levels above 85 dB on a daily basis and the employer did not perform annual training for employees included in the hearing conservation program.
