OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee used a pallet on the forks of a TCM Model FG20 forklift as a work platform. a) Back Lot - An employee stood on a 4 foot 8 inch high pallet platform that was supported by the forks of a TCM Model FG 20 forklift without the benefit of any restraining means or fall protection in place or the pallet being secured, thereby exposing the employee to a serious hazard, observed on or about 3-3-16. ABATEMENT CERTIFICATION REQUIRED
