29 CFR 1926.451(f)(4): Part(s) of a scaffold that were damaged or weakened, such that the scaffold's strength was less than that required by paragraph (a) of this section, were not immediately repaired, replaced, braced to meet those provisions, nor removed from service until repaired. (a) On or about March 3, 2016, at the Naval Base San Diego Lodge worksite, the ladder on the scaffold contained three bent and damaged rungs. The scaffold ladder was not repaired prior to use, exposing employees to fall hazards when ascending and descending. IN THE ALTERNATIVE: 29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, were not withdrawn from service until repaired: (a) On or about March 3, 2016, at the Naval Base San Diego Lodge worksite, the ladder on the scaffold contained three bent and damaged rungs. The ladder was not repaired prior to use, exposing employees to fall hazards when ascending and descending.
