OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard. Shop Area: Employees were using a Yale electric chain hoist, rated at 3 tons, without a safety latch installed on the hook, to lift equipment, including but not limited to, small and large size batteries and other forklift parts. The employer failed to install a safety latch on the Wilbart hook as per ANSI B30.16-2012, Section 16-1.2.9 (hooks), thereby exposing employees to a struck by hazard, on or about, 3/7/16.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-2015, which is incorporated by reference as specified in CFR 1910.101: a) Compressed Gas Storage (Outdoors): Acetylene, propane and oxygen compressed gas cylinders were stored together. The employer failed to separate compressed fuel gas cylinders from oxygen gas cylinders, as per Section 6.2.1 of the Compressed Gas Association Pamphlet P-1-2015, on or about, 3/7/16.
